Human-in-the-Loop Constraint
Agentivity is a draft-generation tool. The Service does not send emails or execute actions automatically without your explicit approval. You are solely responsible for reviewing and approving all outgoing communications.
1. Agreement to Terms
By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Service.
2. Subscriptions, Trials, and Billing
Access to the Service requires an active subscription:
- Pricing: The Service is billed on a monthly subscription model at **$79/month**.
- Trial: We offer a 7-day free trial. You must cancel before the end of the trial to avoid being charged.
- Cancellation: You may cancel at any time. Access continues until the end of your billing cycle.
3. User Responsibility & AI Content
You acknowledge and agree that:
- You assume full liability and responsibility for the contents of all messages sent from your connected accounts, including any inaccuracies, contractual commitments, or legal errors in AI-suggested drafts.
- Agentivity shall have no liability for any disputes, damages, losses, or negative outcomes arising from communications sent using the Service.
4. Limitation of Liability & Warranty Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTIVITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR USE, RESULTING FROM:
- Your use of or inability to use the Service.
- Any security incident, breach, data leak, data loss, or unauthorized access.
- Any errors, inaccuracies, or faults in the AI-generated drafts.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE LESSER OF $100.00 OR THE TOTAL FEES PAID BY YOU TO AGENTIVITY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
5. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to conflict of law provisions. Disputes shall be resolved exclusively in the state or federal courts located in Delaware.
